1. Purpose of the Service: The Service, provided by BuiltCold (hereinafter referred to as "we," "us," or "our"), operates as an intermediary to connect entities in the construction industry (the "Users") with suppliers providing low carbon material alternatives.
2. Data Collection and Usage: We collect personal data such as names, affiliations, and contact information of the Users (the "User Information") to facilitate our services. The User Information shall be stored, utilized, and protected in accordance with our Privacy Policy.
3. User's Rights: The Users retain the right to inspect, amend, or delete their User Information, subject to any statutory or legal obligations that may mandate the retention of certain data.
4. Acceptable Use Policy: The Users shall refrain from duplicating, disseminating, or monetizing any data procured from our Services. Any contravention of this clause may result in punitive action, including but not limited to the suspension or termination of the User's account.
5. Eligibility: As a business-to-business (B2B) service, BuiltCold is exclusively available to commercial entities and their representatives. We impose no restrictions based on age.
6. Billing and Subscription: Our services are currently offered at no cost. Registration is required to access our Service.
7. User-Generated Content: At this juncture, BuiltCold does not support or permit User-generated content.
8. Government and Non-Profit Data: Our service utilizes data obtained from publicly available sources, including but not limited to Sam.gov and BuildingTransparency.org. We do not control or guarantee the accuracy or completeness of this data, which may be subject to change.
9. Intellectual Property: We retain all intellectual property rights pertaining to any information, data, logos, brands, and service names featured on our platform.
10. Limitation of Liability: To the maximum extent permitted by law, BuiltCold shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
11. Warranties: The service is provided on an "as is" and "as available" basis. As a beta product, BuiltCold makes no warranties, expressed or implied, about the reliability, availability, or ability of the service to meet your needs.
12. Indemnification: You agree to indemnify and hold harmless BuiltCold, its officers, directors, employees, and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the services or your violation of these Terms.
13. Termination: BuiltCold reserves the right to terminate or suspend your access to the service if we find you're abusing our services or unlawfully distributing our data.
14. Changes to Terms of Service: BuiltCold may revise these Terms of Service at any time without notice. By using this service, you are agreeing to be bound by the then current version of these Terms of Service.
